RBC: companies that left Russia can intensify the filing of financial claims

The lawsuits against the Cinema Park and Mirage Sinema cinema networks state that the claims are related to the recovery of principal and interest under a contract concluded in December 2019. According to Ksenia Zakharenko, a lawyer of the dispute resolution practice of Lemchik, Krupsky and Partners, compliance by the parties to the transaction with the limitation periods, the violation of which acts as an independent basis for refusing to satisfy the claim, is extremely important. “In this regard, we believe that the departed companies will take measures to comply with this deadline,” Zakharenko said. A similar point of view is shared by Forward Legal lawyer Denis Khairullin. It is noted that foreign companies, seeking to protect their interests, can step up filing claims before the statute of limitations expires. However, according to Inga Shakhnazarova, partner and head of legal practice of TeDo, the three-year anniversary of the events of 2022 will not lead to a sharp surge in disputes, since there are many legal nuances in the calculation of the limitation period. "Foreign companies have either already reached certain agreements with counterparties, or simply written off losses," Shakhnazarova said. Earlier, the Chairman of the Duma Committee on the financial market Anatoly Aksakov said that about 300 foreign organizations showed the desire and readiness to return to the Russian market. According to studies in 2022, more than 500 foreign companies left Russia. In 2023, about 20 companies returned to the market.
