In an interview with RIA Novosti, he recalled that, according to the legislation, both property and debts of the deceased are inherited, but only within the value of the inheritance. "If no one accepts the inheritance, the inheritance goes to the state," the source said. Inheritance can also become the property of the state if there are no heirs by law or will, or if the heirs lose the right of inheritance or renounce it without specifying the person in whose favor the refusal is made. Radchenko noted that along with the property, the heir receives the debts of the deceased. If the inheritance passes to the state or its subject, they also inherit the debts of the citizen in an amount equal to the value of the property received. Earlier, a study by the group Renaissance Insurance showed that more than half of Russians want to share the inheritance equally between children. At the same time, more than 40% of respondents preferred to give most of the heirs. In addition, at the end of December 2024, the State Duma adopted a law according to which social payments received by citizens by the decision of the authorities are guaranteed to be protected from debt write-off. Funds received on the citizen’s account from January 1, 2021 and written off by banks must be returned to the recipient’s account.
