Residents of one of the apartment buildings in Tomsk appealed to the court, as the chairman of the HOA refused to give them reporting documents, including minutes of meetings and financial reports. Residents of one of the apartment buildings in Tomsk appealed to the court, as the chairman of the HOA refused to give them reporting documents, including minutes of meetings and financial reports. The court ordered the HOA to hand over these documents, but the chairman ignored the decision. This is reported by the press service of the FSSP of Russia in the Tomsk region.
The bailiffs gave the HOA 5 days to transfer documents, but the chairman did not, and the partnership was fined 50 thousand rubles. Subsequently, the HOA continued to be fined for non-compliance with the requirements of bailiffs. The fact that the debtor maliciously evaded the execution of the court decision was established by the interrogator of the department, initiating a criminal case under Art. 315 of the Criminal Code of the Russian Federation (Non-execution of the court decision). In court, the interrogator proved that the chairman had the opportunity to transfer the existing documents, as well as make the necessary requests to state portals in order to obtain the missing data and transfer them to their owners. The court found the chairman guilty and imposed a fine of 40 thousand rubles.
