RBC: Russia plans to introduce a new way to control companies with shadow employment

The initiative to expand the list of risk indicators in labor law was made by the Ministry of Labor. These indicators serve for risk-oriented control of the business: they are not violations, but indicate a high probability of their presence and require verification. Despite a moratorium on unscheduled inspections, facilities with identified indicators could be excluded from the rule, experts explained. According to RBC, the Ministry of Labor proposes to add to the list of risk indicators a paragraph on the receipt of the protocol of the interdepartmental commission to combat illegal employment, which contains information about the signs of such employment in the company, for example, the absence of an employment contract or the use of a civil law contract for labor relations. The condition will be the absence of the controlled person to attend the meetings of the Commission more than twice in six months. The initiative will be considered by the subcommittee on improving the functions of federal bodies within the framework of the government commission on administrative reform. The Ministry of Labor hopes that the new indicator will increase the effectiveness of the fight against illegal employment, allowing you to transfer the collected information to Rostrud for action. After that, the inspectorate, having coordinated its actions with the prosecutor's office, will be able to conduct inspections. Earlier, Mikhail Kirsanov, Director of the Department of Employment and Labor Migration of the Ministry of Labor of Russia, pointed to the problem of the absence of interdepartmental commissions of influence on employers with signs of shadow employment, since they can ignore meetings and evade decisions. It was also reported that in 2024, about 10 million Russians (13% of the working-age population) conducted banking operations in favor of shadow business, online casinos and for cashing out money, including transfers to dropper cards that open bank cards for questionable transactions.
