“Izvestia”: drivers of car sharing face increased fines

In October 2022 in St. Petersburg, a car sharing user parked a rental car on the lawn, violating the rules. This was recorded by an automatic camera. The culprit of the violation was recognized by the car sharing operator as the owner of the car, he as a legal entity was fined 150 thousand rubles. The car sharing operator did not agree with the decision, considering that he was not the culprit, since the car was in use by the customer. The firm asked to cancel the fine. If the courts agreed with these arguments, the fine for violation of parking rules would be issued to the direct violator, an individual, the fine would be 5 thousand rubles. Three courts rejected the arguments of the car sharing operator, so the company appealed to the Supreme Court (Russian Armed Forces). The judge of the Armed Forces of the Russian Federation came to the conclusion that the norms of substantive law were applied correctly, violations of the rules of procedural law were not allowed during the proceedings in the case. The Supreme Court decided to uphold the decision of the State Administrative and Technical Inspectorate, as well as the verdicts of lower instances and refuse to satisfy the complaint of the car sharing operator. In Moscow, a similar violation, according to the capital’s administrative code, would cost the car sharing operator as a legal entity already in 300 thousand rubles. According to the Vice-President of the National Automobile Union (NAS) Anton Shaparin, the Supreme Court is quite scrupulously versed in the nuances of “car” cases, but in this situation made a straightforward decision – did not understand the logic and mechanisms of car sharing. By its decision, the Russian Armed Forces indicated that the facts presented by the company do not prove the driver’s guilt. Referring to this decision, the motorist may well challenge the claims made to him by the car sharing operator. In this case, according to the expert, the already low culture of driving and parking for users of short-term car rental services will become even lower. Earlier, the official representative of the Ministry of Internal Affairs Irina Volk reported that the department opposes the introduction of fines for exceeding the average speed on a certain section of the road. She stressed that the information on the elaboration of this issue in the Ministry of Internal Affairs is fake.
